Wayv is a mobile platform for ordering transport by Slovenian sea. It acts as an intermediary between shipping service providers and passengers who want to transport by Slovenian sea. Use of the application is free of charge, the passenger only pays the price of transport, which is determined by the transport provider.
As operations and operations today are inevitably connected with the processing of personal data, one of our commitments is to respect the privacy of our employees, partners and visitors to our platform, registered users, carriers – transport service providers and other individuals and protect their personal data. , undertaking to handle the personal data collected in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95 / 46 / EC (hereinafter: GDPR) and the national rules governing this field.
EMIGMA d.o.o. for the purpose of implementing the agreement from the General Terms and Conditions of the Wayv platform (links between the requester and the provider) and for the purpose of performing the selected transport service, exchanges certain personal data of users (name, surname, telephone number) with the selected carrier only after the conclusion of the final transport agreement. Until the stage of concluding a final agreement between the user and the carrier, the demand to the carriers is visible only in an anonymised form (initial and final or desired destination, number of passengers). The exchange of such information is necessary in order for the selected carrier to be able to establish contact with the user with whom it has concluded an agreement for the purpose of implementing the concluded transport agreement. In this part, the selected carrier acts as an independent controller of the received personal data.

Emigma d.o.o. is a trusted controller of personal data. We understand and are aware of the importance of trust, security and privacy of all individuals and we also respect it. We also protect the privacy of all individuals by developing technology that enables a secure online experience.

Emigma d.o.o. does not have a data protection officer because we do not process personal data to such an extent that this obligation should be fulfilled
Purposes of personal data processing and legal bases
a) Emigma d.o.o. the personal data of registered users of the Wayv platform – individuals who create a user account in the Wayv Routs mobile application and carriers registered and involved in the Wayv project – processes within and for the purpose of implementing contracts, supporting users and carriers, including for the purpose of concluding contracts and during the negotiation phase and after receiving the individual’s offer (Article 6 / I point b of the General Regulation). The data obtained for the purpose of exercising the rights and obligations of the user and the carrier of the platform and further processed for this purpose are precisely defined in the General Terms and Conditions of the Wayv platform, which are available on the website www.wayv.si.
Under the contract EMIGMA d.o.o. also processes personal data of employees necessary for the conclusion and implementation of rights and obligations arising from the employment relationship to the extent specified by the Labor Market Act ( [1] ) or the Employment Relationships Act ( [2] ).
b) Emigma d.o.o. processes personal data of individuals (associates, partners, visitors and users of the portal, carriers and others) also on the basis or. within the legal basis (Article 6 / I point c GDPR) and on the basis of other international treaties, EU regulations and national laws, which require the controller to provide personal data of individuals to state authorities in certain cases, such as the Ministry of the Interior, FURS, various inspections, etc.) and other operators (such as ZZZS, ZRSZ, ZPIZ, etc.) to fulfill their or their legal obligations or competencies.
c) Emigma d.o.o. on the basis of a legitimate interest (Article 6 / I point f of the General Regulation) processes personal data for the purpose of reducing the risk of intrusions on our website or. platform (providing information security, reducing the risks of unauthorized access to important business information, intellectual property, personal data, preventing misuse of the portal and providing an information system). In connection with access to the Wayv platform, the operator monitors the technical information of your browser, computer or mobile device. In this case, the following data is collected for identification purposes: computer IP address, browser type, domain names, access date and time, and pages visited on the portal. In addition to the purpose of reducing the risk of intrusions and unauthorizedThese data may also be used for analytical and statistical purposes and for the purpose of the various analyzes and statistics needed to verify the correctness of business decisions and to plan new ones.
d) Emigma d.o.o. in certain cases, it asks individuals to give their consent (Article 6 / I point a of the GDPR) to the processing of their personal data when the processing of this data is necessary for purposes not defined in the legal basis and for the purpose of sending news about our services and services of our business partners. In this case, the processing of personal data takes place within the framework of the individual’s statement of the permitted scope of personal data, purpose and agreed information channels, until revoked.
If a person is under the age of 16, consent is given by his or her parents or guardians when it comes to information society services.
e) The processing of personal data of visitors to the Wayv platform (mobile and / or online services Wayv) is based on their consent, except in the part of personal data processing that is necessary to ensure the proper functioning of our website or. mobile applications. Users of personal data and possible transfer of personal data to third countries
In addition to the controller, personal data is also processed on our behalf and for our account by our processors, typically IT support providers in the processing of personal data or other contractual partners, and the company’s personal data is also processed by external users, namely authorities by law.
Personal data of individuals are not exported to third countries.
Individual rights
With a written request sent to the address: Emigma d.o.o. , Ankaranska cesta 5c, 6000 Koper or wayv@emigma.com , an individual may request access, supplementation, correction, blocking or restricts the processing or deletion of personal data, objects to the processing of data processed in connection with it and requests the transfer of data.

Withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until its withdrawal.
An individual has the right to lodge a complaint with the Information Commissioner of the Republic of Slovenia if he or she considers that his or her personal data is stored or otherwise processed in contravention of the applicable regulations governing the protection of personal data.
Personal data retention periods
Emigma d.o.o. will process personal data to the extent necessary to achieve the purposes of the processing and for as long as is necessary to achieve the pursued goal.
We thus process personal data until the fulfillment of the purpose or within the limitation periods for obligations that could arise from the processing of such personal data, especially when the processing of personal data is necessary in the context of concluding or performing a contract, except in cases where the retention period is personal. data required by law. In the latter cases Emigma d.o.o. keeps the data in accordance with the legal order.
